Directions to the Ranch From Burwell, Nebraska: Approximately 26 Miles North/Northeast on Nebraska State Highway 11 and then east on 848 Road 1.5 miles to the west edge of the property. From Atkinson, Nebraska: Approximately 29 miles South on Nebraska State Highway 11 and then east on 848 Road 1.5 miles to the west edge of the property.

Auction Description

Terms and Conditions

 

 

 

Possession 

 

Buyer shall receive full possession of the ranch at closing, other than the bunkhouse.  Seller shall retain possession of the Bunkhouse on the property until May 1, 2019.  Seller shall pay for electricity or any other utility expenses incurred for the bunkhouse until May 1, 2019.

 

 

 

Sale Procedure

 

The ranch will be offered for sale as one single parcel containing 2,360+/- Deeded Acres in Holt County, Nebraska, known as the “Stevens Ranch”.   The Live Auction will be considered an Absolute Auction only after the reserve bid of $3,600,000.00 has been met.  In the event the reserve bid is not met, the Sellers reserve the right to negotiate with the highest bidder to complete a transaction.  All bidding increments are at the sole discretion of Land Marketers Realty and the Auctioneer. 

Bidding will remain open until the Auctioneer declares the land SOLD.

Land Marketers Realty reserves the right to require bank references upon request and reserves the right to refuse bids from any bidder.

 

 

 

 Purchase Agreement

 

Immediately following the closing of the auction, the successful bidder(s) will sign Brokerage Disclosure and will enter into and sign a Contract to Buy Real Estate (Land) for the amount of the bid. Required non-refundable earnest money deposit to be in the form of a personal, business, or corporate check for an amount equal to10% of the purchase price which is due upon the signing of the contract and to be deposited with McCarthy Abstract in O’Neill, NE. (Title Company and Closing Agent) The Purchase Agreement will not be contingent upon financing. Terms and conditions of the auction announcements shall be incorporated and made a part of the contract.

 

Closing

 

 Buyer(s) shall pay in electronic transfer funds or cashier's check, the balance of purchase price with the added closing costs, and sign and complete all required documents at closing.  Buyer shall have the choice to close on or around December 28, 2018 or January 14, 2019. Closing to be conducted by McCarthy Abstract and the closing service fee to be split 50-50 between Seller and Buyer(s).

 

 

 

Title 

 

Seller shall convey title by Warranty Deed free and clear of all liens. Title Insurance to be used as evidence of marketable title and cost of the premium to be split 50-50 between Seller and Buyer(s). Property to be sold subject to existing roads and highways; established easements and rights-of-way; any prior mineral reservations; and other matters affected by title documents shown within the title commitment; and zoning, building, subdivision, and other restrictions and regulations of record. Title commitments will be available for review at the auction.

 

 

 

Property Condition

 

The prospective Buyer(s) should verify all information contained herein. All prospective bidders are urged to fully inspect the property, its condition, and to rely on their own conclusions and the property is being sold AS IS-WHERE IS, without warranty, representation or recourse to Seller or Seller’s Agent. Furthermore, Buyer shall sign all Property condition Disclosure Statements and Lead Based paint disclosure which will be made available to the Buyer(s), for the Buyer (s) review, prior to the auction sale.

 

Real Estate Taxes 

 

2018 real estate taxes due in 2019, to be paid by Seller.

2019 and all future real estate taxes to be paid by Buyer(s).

Legal descriptions are subject to existing fence boundaries.  Neither Seller or Seller’s Agent represents the location of any fence lines or boundary lines.  All stated acreages in the brochure or any advertising are approximate and are obtained from county tax records.  No warranty is expressed or implied as to exact acreages of property. Mineral Rights   

 

Seller to convey all OWNED mineral rights to Buyer(s) at closing.

 

 

 

#1031 Exchange    

 

The Seller of this property shall have the option to execute a Tax Deferred #1031 Exchange, which shall not delay the closing of this Sale/Purchase Transaction.  Furthermore, said #1031 Exchange shall not be any additional expense to the Buyer.

 

Noxious weeds

 

There are noxious weeds present in the local area.  Examples of said weeds would be Canada Thistle, Musk Thistle, or Leafy Spurge.
